Is it easy to migrate to the USA?

This is the first question you need to ask yourself before you start getting excited. Let’s face it. Migrating to the US is not a straightforward task. Why? This beautiful country, which many consider as the land of opportunities, limits the number of people who can come here to reside permanently.

This however does not mean it’s difficult to migrate. There are several easy and proven ways you can use if you want to come here to live permanently. I have taken my time to explore these options.

1. Obtaining a green card through the American DV lottery

One of the easiest ways to immigrate to the US is through participating in the American diversity visa lottery program (American DV lottery). This is the route I followed to move to the US together with my family.

In 1999, the American concreate created the DV program to allow 55,000 people from selected countries to come to the year every year. Under the American DV lottery, citizens of countries with low rates of immigration to the US can apply to be considered. This excludes nationals of countries such as China, Canada, Brazil, Philippines, Pakistan, Mexico, Jamaica, India, Haiti, Russia, Poland, Peru, Ecuador, Colombia, Dominican Republic, Vietnam, South Korea, and United Kingdom (except Northern Ireland.

The application period is between October and November each year. You must have at least a high school education or two-years work experience to be eligible to apply.

2. Obtaining a green card through A US citizen/permanent resident relatives

The second way to immigrate to the US is to obtain a green card through a US citizen or permanent resident relative. You will have to be an immediate relative in order to be eligible for a green card under this option. You are an immediate relative if:

  • You are unmarried minor children of US citizen. If your parents are US citizens, they can petition for you to immigrate to the US. However, you have to be unmarried and under 21 years to be eligible for this option.
  • You are a parent of US citizen (Your son or daughter is a US citizen or permanent resident). If you have a son or daughter is a US citizen is over 21 years of age, they can petition for you to immigrate to the US.
  • You are a spouse of US citizens (Your wife or husband is a US citizen or permanent resident). Since this is the most common source of immigration fraud, you are required to file a joint petition together with your spouse (wife or husband) two years after moving to the US to prove the marriage is still valid.
  • You are a brother or sister of a US citizens. You are eligible to immigrate to America but the US citizen who file a petition for you must be at least 21 years old. The waiting period for this option is between 12 and 22 years depending on the country of birth.

Just keep in mind that being unmarried son or daughter of a US citizen does not guarantee you automatic entry. Since there are thousands of petitions file each year, the country limits the number of unmarried minors who can immigrate to the US each year.

Same case applies to spouses and minor children of permanent residents. There is no automotive guarantee. In some instances, you will have to wait for 5 to 8 years after a visa petition is filed for you to immigrate to the US.

In a nutshell, the process of obtaining a green card through A US citizen or permanent resident relatives starts by filing a visa petition. The petition is filed in the US by your relative. Once the petition is approved, your relative will have to apply for a permanent residence.

3. Obtaining a green card through us employment requiring labor certification

The third easiest way you can immigrate to America is to obtain a green card through US employment requiring labor certification.

Labor Certification is a process where a US employer/company that wants to hire foreigners proves to the authorities that there is indeed a shortage of qualified US nationals to handle the job. The US employer needs to advertise the available positions on the newspaper and other media platforms. If a qualified US national is not found after the advertisement, the US employer is given a labor certification. The certification allows the employer to hire a foreigner to do the job.

A US employer with a labor certification has two options. First, they can file an EB-2 visa or an EB-3 for any foreigner they want to hire. The first visa, EB-3, is for member of professions holding advanced degrees or aliens of exceptional ability. The second visa, EB-3, is for professionals, skilled workers who require more than two years of education, training or experience and other workers who requires less than two years of education, training or experience.

4. Obtaining a green card through employment not requiring labor certification

Some employment opportunities in the US does not require a US employer to obtain a labor certification. You can easily immigrate to the US under these employment opportunities. These employment-based immigration options include:

  • Employment-Based First Preference (EB-1): You can obtain a green card to work in the US as a priority worker. This means you can move to the us if you are a manager or executive of a multinational company, an outstanding professor or researcher, or have extraordinary ability.
  • Employment-Based Fourth Preference (EB-4): You can obtain a US green card if you are a religious worker or fall under a special immigrant category.
  • Employment-Based Fifth Preference (EB-5): If you have at least one million dollars and wants to invest in the US, you can qualify for a green card under this category.

5. Obtaining a green card as a political asylee or refugee

Another easy way to immigrate to the US is to obtain a green card as a political asylee or refugee. This means you will be eligible to apply for permanent residence after one year if you have been granted political asylee or refugee status.

The number of people who can move to the US under this option are determined each year by the president. In 2022, more than 80,000 refugees and political asylees were granted entry by the president.
